Exigimos a forte prote\u00e7\u00e3o de seu trabalho e seu reconhecimento como defensores de direitos humanos.<\/p>\n
Seja atrav\u00e9s de leis que criminalizam sua atividade ou atrav\u00e9s de persegui\u00e7\u00e3o judicial que visa silenci\u00e1-los e puni-los, seus trabalhos e vidas est\u00e3o sendo comprometidos. Essa tend\u00eancia tem um efeito prejudicial sobre os direitos humanos, tanto online quanto offline. Casos como a interfer\u00eancia pol\u00edtica no processo criminal contra Ola Bini no Equador, a investiga\u00e7\u00e3o e as medidas arbitr\u00e1rias tomadas contra Javier Smaldone na Argentina, bem como os casos de Alaa Abd El Fattah no Egito, Fikret Baskaya na Turquia, Ahmed Mansoor nos Emirados \u00c1rabes Unidos e muitos outros fazem parte de uma tend\u00eancia global crescente e perigosa.<\/p>\n
O trabalho que os defensores dos direitos digitais realizam em defesa da privacidade \u00e9 fundamental para a prote\u00e7\u00e3o dos direitos humanos. Quando conscientizam sobre a exist\u00eancia de vulnerabilidades nos sistemas, eles permitem que os setores p\u00fablico e privado encontrem solu\u00e7\u00f5es que melhoram a infraestrutura e a seguran\u00e7a de softwares para o benef\u00edcio do p\u00fablico. Al\u00e9m disso, seus trabalhos como consultores de seguran\u00e7a para jornalistas e ativistas de direitos humanos \u00e9 de vital import\u00e2ncia para a seguran\u00e7a de jornalistas, ativistas e outros defensores de direitos humanos.<\/p>\n
O trabalho dos defensores dos direitos digitais \u00e9 um exerc\u00edcio leg\u00edtimo do direito \u00e0 liberdade de express\u00e3o e, como tal, deve ser protegido. Os Relatores Especiais sobre o Direito \u00e0 Liberdade de Opini\u00e3o e Express\u00e3o da Organiza\u00e7\u00e3o dos Estados Americanos e das Na\u00e7\u00f5es Unidas expressaram preocupa\u00e7\u00e3o pelas deten\u00e7\u00f5es e processos contra defensores dos direitos digitais como Ola Bini. A codifica\u00e7\u00e3o \u00e9 apenas mais uma forma de expressar ideias no que geralmente \u00e9 conhecido como linguagens de alto n\u00edvel. Ainda mais, suas pesquisas s\u00e3o uma manifesta\u00e7\u00e3o de busca, recebimento e compartilhamento de informa\u00e7\u00f5es. Esse direito \u00e9 essencial quando as informa\u00e7\u00f5es buscadas s\u00e3o cr\u00edticas para a governan\u00e7a p\u00fablica, protegendo a privacidade e a seguran\u00e7a da infraestrutura.<\/p>\n
Rejeitamos toda persegui\u00e7\u00e3o aos defensores dos direitos digitais. Exigimos o reconhecimento de seu trabalho nos n\u00edveis jur\u00eddico, social e pol\u00edtico. Os defensores dos direitos digitais tamb\u00e9m devem ser reconhecidos como defensores de direitos humanos quando trabalham pela defesa dos direitos humanos fundamentais ou de qualquer outra forma pelo interesse p\u00fablico. Portanto, seu trabalho e seus direitos b\u00e1sicos devem ser protegidos para garantir o desenvolvimento seguro, transparente, democr\u00e1tico e protegido da internet e das tecnologias digitais em todo o mundo. Eles devem poder realizar seus trabalhos sem medo de ass\u00e9dio judicial ou qualquer outra forma de dano proveniente do Estado.<\/p>\n

Leia a carta em ingl\u00eas:<\/strong><\/em><\/p>\n The undersigning civil society organizations express our concern over the global trend of persecuting digital rights defenders \u2013including security researchers and trainers who act to protect and promote human rights. We demand the strong protection of their work and their recognition as human rights defenders.<\/p>\n Either through laws that criminalize their activity or through judicial persecution meant to silence and punish them, their work and lives are being jeopardized. This trend has a detrimental effect on human rights, both online and offline. Cases like the political interference in the criminal case against Ola Bini in Ecuador, the investigation and the arbitrary measures taken against Javier Smaldone in Argentina, as well as the cases of Alaa Abd El Fattah in Egypt, Fikret Baskaya in Turkey, Ahmed Mansoor in the UAE and many others, are part of a growing and dangerous global trend.<\/p>\n The work digital rights defenders do in defense of privacy is fundamental for the protection of human rights. When they raise awareness about the existence of vulnerabilities in systems, they allow the public and private sector to find solutions that improve infrastructure and software security for the benefit of the public. Furthermore, their work as security advisers for journalists and human rights activists is of vital importance for the safety of journalists, activists and other human rights defenders.<\/p>\n The work of digital rights defenders is a legitimate exercise of the right to freedom of expression and, as such, it must be protected. The Special Rapporteurs on the Right to Freedom of Opinion and Expression from the Organization of American States and the United Nations have expressed concern for the detention and prosecution of digital rights defenders like Ola Bini. Coding is just another form of expressing ideas in what is usually known as high-level languages. More importantly, their research is a manifestation of seeking, receiving and sharing information. This right is essential when the information sought is critical for public governance, protecting privacy and infrastructure safety.<\/p>\n We reject all persecution of digital rights defenders. We demand the recognition of their work at the legal, social and political levels. Digital rights defenders should also be recognised as human rights defenders when they work for the defense of fundamental human rights or in any way for public interest. Hence, their work and their basic rights must be protected to ensure the safe, transparent, democratic and secure development of the internet and digital technologies across the world.
