Os princ\u00edpios s\u00e3o co-assinados por mais de cem organiza\u00e7\u00f5es de todo o mundo, entre elas a Rede Latino-Americana de Estudos sobre Vigil\u00e2ncia, Tecnologia e Sociedade . Na lideran\u00e7a desse processo estiveram a EFF e a Privacy International.<\/p>\n<p>Os direitos humanos s\u00e3o um princ\u00edpio interessante para conseguir algum norte em termos de o que \u00e9 b\u00e1sico para se proteger. A declara\u00e7\u00e3o universal dos direitos humanos \u00e9 um documento que goza de unanimidade e prest\u00edgio internacionais. \u00c9 a partir dela que essa coaliza\u00e7\u00e3o prop\u00f5es alguns princ\u00edpios para colocar regulamentar e estabelecer bases que encerrem as iniciativas de\u00a0 vigil\u00e2ncia governamental descontrolada que foram reveladas nos \u00faltimos meses &#8211; mas que v\u00eam acontecendo j\u00e1 h\u00e1 alguns anos. Diz o <a href=\"https:\/\/www.eff.org\/deeplinks\/2013\/07\/thirteen-principles-for-human-rights\">comunicado da EFF<\/a>:<\/p>\n<blockquote><p>Eles [os princ\u00edpios] incluem requisitos que a lei de vigil\u00e2ncia garanta que todas as intercepta\u00e7\u00f5es sejam legais, e por um fim leg\u00edtimo, necess\u00e1rio, proporcional e adequado; ser supervisionada por uma autoridade judici\u00e1ria competente; incluem a transpar\u00eancia, notifica\u00e7\u00f5es de usu\u00e1rios, sob supervis\u00e3o p\u00fablica e devido processo legal, proteger a integridade dos sistemas de comunica\u00e7\u00e3o e incluir salvaguardas dos direitos humanos contra o acesso ileg\u00edtimo e uso indevido de procedimentos de coopera\u00e7\u00e3o entre os Estados.<\/p>\n<p>A libera\u00e7\u00e3o dos princ\u00edpios vem na esteira de um relat\u00f3rio do Relator Especial da ONU sobre o Direito \u00e0 Liberdade de Opini\u00e3o e Express\u00e3o, que detalha o uso generalizado de vigil\u00e2ncia estatal de comunica\u00e7\u00e3o. O relat\u00f3rio afirma que tal vigil\u00e2ncia mina severamente a capacidade dos cidad\u00e3os de desfrutar de uma vida privada, de expressarem-se livremente e de desfrutarem de seus outros direitos humanos fundamentais. Recentemente, o Comiss\u00e1rio da ONU para os Direitos Humanos, Navi Pillay Nivay, enfatizou a import\u00e2ncia da aplica\u00e7\u00e3o de normas de direitos humanos e as garantias democr\u00e1ticas para vigil\u00e2ncia e atividades de aplica\u00e7\u00e3o da lei.<\/p><\/blockquote>\n<p>O documento foi o resultado de um ano de consulta da sociedade civil e especialistas em privacidade e tecnologia. Written in response to the increasing number of government surveillance standards that focus on law enforcement and &#8220;national security&#8221; priorities instead of citizens&#8217; rights, the principles include advice on how surveillance laws should respect the law, due process, and include public oversight and transparency. Current debates over government surveillance are often limited by outmoded definitions of content versus metadata, or stored data versus data in transit. The principles released today concentrate on the core issue: how human rights protect all information that reveals private information about an individual&#8217;s communications.<\/p>\n<p>&#8220;It&#8217;s time to restore human rights to their place at the very heart of the surveillance debate,&#8221; said EFF International Director Danny O&#8217;Brien. &#8220;Widespread government spying on communications interferes with citizens&#8217; ability to enjoy a private life, and to freely express themselves \u2013 basic rights we all have. But the mass metadata collected in the U.S. surveillance program, for example, makes it extraordinarily easy for the government to track what groups we associate with and why we might contact them. These principles announced today represent a global consensus that modern surveillance has gone too far and must be restrained.&#8221;<\/p>\n<p>The organizations signing the principles come from more than 40 different countries. The principles will be used to advocate for a change in how present laws are interpreted, and new laws are crafted.<\/p>\n<p>&#8220;International human rights law binds every country across the globe to a basic respect for freedom of expression and personal privacy,&#8221; said EFF International Rights Director Katitza Rodriguez. &#8220;The pervasiveness of surveillance makes standing up for our digital rights more important than ever. And we need those rights to survive in a digital world, where any state can spy on us all, in more detail than ever before. We know that surveillance laws need to be transparent and proportionate, with judicial oversight, and that surveillance should only be used when absolutely necessary.
